Trial Attorneys: When Going to Court is Inevitable

Despite what is being seen on television dramas, most cases do not always have to go to trial. In fact, most attorneys would prefer that the majority of cases be settled with a plea agreement before having to get to the point of having a trial. Of course, this does not always happen, so you will need a trial attorney that is not only qualified to represent you, but is experienced in trial law as well. Remember, 'able' does not always equal ability, especially when it comes to trying a case before a jury.

Trial attorneys must have a sense of experience about them or the jury may not have any respect for him. When you meet two people, do you notice the one who is confident and obviously in control of the situation, or the nervous and unsure one? In trial law, one minor misstep can end a case, so having a trial attorney who is making his trial debut may be dangerous, especially where the cases are for serious crimes. Keep in mind that the more serious the crime you are being charged with, the less likely the prosecuting attorney will be to take a plea agreement, especially if he has a strong case against you.

A good trial lawyer would then be one who is always thinking one step ahead. He will be thinking about the "what if's" of the case and will have the trial mapped out in his head before it even begins. You will probably be coached about responses unless your trial lawyer does not intend to put you on the stand at all. (This becomes more likely if doing so would only harm your case). A good trial attorney is ready for surprises and will be well prepared, seemingly down to the last detail.

Once a trial begins, each side will be given the opportunity for opening statements and this is where many trial attorneys shine. They say that many a case has been won or lost on the opening statement, so it is imperative that the words be strong, both in their meaning and their delivery.

Think about your first meeting with the trial attorney- did you seem impressed or did you leave thinking that he was timid and withdrawn? If you know that you are going to be forced to go to trial with your case, you want someone who will wow the jury from the first word of the first sentence and will be able to control the situation to your benefit.
